§ 1
Definitions

The following definitions apply in these Terms and Conditions:

• “Website owner” – the Merkaba Foundation, registered under no. KRS 0000886754, tax ID (NIP) 7011023379, with its registered office in Warsaw 00-545 at ul. Marszałkowska 58.
• “User” – every individual who visits the www.merkaba.org.pl website and voluntarily accepts the Terms and Conditions of using the Website, the Privacy Policy and the Cookies Policy;
• “Terms and Conditions” – this document constituting the Website Owner’s terms and conditions of using the Website;
• “Website” – the website administered by the Owner at www.merkaba.org.pl
• Contact Form – the online form for the Website User to contact the Website Owner or to apply as Volunteer;
• Donor – a User who voluntarily transfers a payment to the Merkaba Foundation bank account in accordance with the terms and conditions of the User’s/Donor’s Bank or via postal service;
• Volunteer – a User who submits the volunteer application form expressing their wish to collaborate with the Website Owner free of charge;
• Web Platform – the web platform administered by.... at URL address....
• Personal Data – information about identified or identifiable individual defined in the Personal Data Protection Act (Journal of Laws /Dz.U./ 2018 item 1000);

§ 2
Application

1. These Terms and Conditions apply to the www.merkaba.org.pl website insofar as they are compliant with the provisions of the Civil Code and other laws and are binding on all Website Users.
2. The Website Owner shall publish these Terms and Conditions at the www.merkaba.org.pl Website in a downloadable, recordable and printable format and shall specify the date since when the published version is valid.

§ 3
Personal Data

1. The Data Controller is the Website Owner.
2. Personal Data collected by the Website Owner via the Website are only used for the purpose of statistical analyses and normal operation of the www.merkaba.org.pl website;
3. The Privacy Policy and the Cookies Policy of the Website Owner are published separately as: “Privacy Policy and Cookies Policy”.

§ 4
Final provisions

1. Any reference in these Terms and Conditions to provision of any personal data means voluntary provision of information via the Contact Form on the Website or electronic mail.
2. If any of the general provisions of these Terms and Conditions is found invalid, illegal or unenforceable by a competent authority, such provision shall be ineffective only to the extent it is invalid, illegal or unenforceable, without prejudice to the validity of the other general provisions of these Terms and Conditions or the validity or enforceability of that provision in another jurisdiction. A questionable or invalid provision shall be replaced with a relevant provision of general law.
3. In matters not covered by these Terms and Conditions, provisions of the Polish Civil Code and other relevant legal regulations shall apply.
4. Any disputes arising from or in association with the use of this Website shall be settled first of all through mediation; if no understanding is reached within a month from the date of requesting the other Party to join mediation, the dispute shall be settled by a competent court in the location of the Website Owner’s registered office.
5. Before using the Website, the User is obliged to read the Terms and Conditions published by the Website Owner on the Website.
6. These Terms and Conditions enter into force as of ..... 2021.
